Top global biopharmaceutical company seeks 5 year attorney with in-house or law firm experience advising commercial stage pharmaceutical or biotech companies to provide legal advice and contracting support to the company’s payer and trade functions and will also support the U.S. legal contracts group with contracting needs, including the drafting, review and negotiation of a variety of agreements with relative complexity, for various other departments in the company. Responsibilities include:
• Serve as the Legal department key point of contact for the company’s payer and trade contract operations and account teams with advice about, and assistance in, drafting and negotiating service and rebate contracts pertaining to wholesalers, distributors, pharmacies and commercial, Medicare Part D, and other government accounts;
• Provide advice on contract compliance matters, as well as subject matter expertise in evaluating healthcare regulatory law issues, such as the rules, regulations and guidance documents issued by OIG, CMS, and FDA and applicable fraud and abuse, anti-kickback, false claims, antitrust, privacy and product liability laws and regulations concerning market access and trade initiatives;
• Participate in, and evaluate, the development of contractual and business strategies with the payer marketing, trade and government pricing teams;
• Interpret key contractual provisions in light of legal or regulatory requirements (in coordination with other attorneys in the Legal Department, including product, compliance, research, corporate and IP attorneys, as necessary) and advise internal clients on the ramifications of certain provisions, such as termination rights, dispute resolution process, liability limitations, indemnification obligations and protection of intellectual property;
• Frequently engage with functional leadership and internal clients in key customer group(s) on emerging contractual needs or potential contractual issues with minimal oversight and guidance from managing attorney; Superb opportunity to work with collegial, top notch legal group.
